Judge jurisdiction - guarantee of the effective person's protection from the unfounded detention

The article is devoted to the up-to-date problem connected with the realization of the qualified administration of justice in an important jurisdiction sphere: grounds for the order of detention, prolongation, change for a less restrictive preventive measure. Precedents of the national court, European Human Rights Court are being analyzed in here. The authors point out legal aspects of different kinds, that negatively influence the bearers of judicial power legal competence, the quality of the judicial acts adopted by them and the main aims of the judicial reform. The region's described working experience of the Research Advisory Council under the jurisdiction of the Republic of Mordovia Supreme Court is of an interest.
