Causing harm in construction: the ratio of the material and tort liability

In the work the problem of distinction between the material and the tort liability of the employee in case of the causing of harm during construction work rises. There were identified criteria, which allow in the framework of the legal theory and practice of application of norms to exclude the situation, when an employer unreasonably making the switch of the institute of material responsibility to the tort liability.
